These Terms of Service (“Terms”) are a binding agreement between you and TeeMates LLC (“TeeMates LLC,” “we,” “us,” or “our”) governing your use of the TeeMates mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 16 years old and able to form a binding contract to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Subject to these Terms, TeeMates LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app for your personal, non-commercial use. You may not copy, modify, reverse engineer, resell, or create derivative works from the Service except as permitted by law.
You agree not to use the Service to:
The Service lets you create and share content, including messages, images, profile information, group and tee-time details, and notes (“User Content”). You retain ownership of your User Content, but you grant TeeMates LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content as necessary to operate and provide the Service. You are solely responsible for your User Content and represent that you have the rights to share it.
There is no tolerance for objectionable content or abusive behavior on the Service. By using the Service, you agree that we may, in our discretion and without prior notice, remove content and suspend or terminate users who violate these Terms. The Service provides tools to:
We aim to review reports of objectionable content and act on them, which may include removing content and ejecting the offending user, within 24 hours where reasonably practicable. To report a concern, use the in-app reporting tools or contact us at matthew.efstathios@teemates.club.
TeeMates is a platform for organizing golf and connecting players. We do not own, operate, or control golf courses, and we are not a party to any arrangement, booking, or game between users. Tee-time details, course information, pricing, and availability may be user-supplied or sourced from third parties and may be inaccurate. You are responsible for your own conduct and safety, for verifying arrangements with courses and other players, and for complying with course rules. You assume the risks associated with golf and with meeting other users.
TeeMates does not process payments and does not collect, hold, or transfer money. Any green fees or shared golf costs are paid directly to the golf course or settled between players in the real world, outside the app. Because any such payments are for real-world goods and services consumed outside the app, they are not processed through Apple in-app purchase.
The Service includes head-to-head “duels,” ratings, leaderboards, course “territory” standings, and badges for entertainment purposes. These features do not involve monetary prizes or wagering provided by us and confer no monetary value. Standings and ratings are calculated by our algorithms and may change or be reset.
By enabling notifications or sending SMS invitations, you consent to receive related messages. You are responsible for ensuring you have permission to invite the contacts you choose. Message and data rates may apply to SMS. You can opt out of notifications in the app or your device settings.
The Service depends on third-party services, including Google and Apple. Your use of those services is subject to their respective terms. We are not responsible for third-party services or content.
The Service, including its software, design, trademarks, and content (other than User Content), is owned by TeeMates LLC or its licensors and is protected by intellectual-property laws. We reserve all rights not expressly granted.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION (INCLUDING COURSE, WEATHER, OR PRICING DATA) IS ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEEMATES LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless TeeMates LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, your interactions or transactions with other users, or your violation of these Terms or applicable law.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Except where prohibited by law, you and TeeMates LLC agree to resolve disputes through binding individual arbitration rather than in court, and you waive any right to participate in a class or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing matthew.efstathios@teemates.club. Nothing in this section prevents either party from seeking relief in small-claims court or injunctive relief for intellectual-property misuse.
The following applies if you obtained the app from the Apple App Store. These Terms are between you and TeeMates LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranties or for addressing any claims relating to the app (including product-liability, legal/regulatory, or intellectual-property claims). In the event of any third-party claim that the app infringes intellectual-property rights, TeeMates LLC, not Apple, is responsible. You represent that you are not located in a U.S.-embargoed country or on a U.S. government prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with applicable third-party terms (e.g., your wireless carrier’s terms) when using the app.
We may update these Terms from time to time. We will post the updated version with a revised “Last Updated” date and, where required, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
